Welcome to Arch Guide. By creating an account or using our app, you agree to these Terms & Conditions and our Privacy Policy. If you don't agree, please don't use the App.

1. Acceptance of Terms

By accessing or using Arch Guide (the "App," "we," "us," or "our"), operated by Arch Guide LLC, you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you and Arch Guide LLC.

2. Age Requirements

You must be at least 18 years old to create an account or use Arch Guide. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

3. Account Registration

• You must provide accurate, current information when creating your account

• You're responsible for maintaining the security of your account credentials

• You're responsible for all activity under your account

• Account sharing is prohibited

• We reserve the right to suspend or terminate accounts at our discretion

4. Permitted Use

You may use Arch Guide for personal, non-commercial purposes. You agree NOT to:

• Use the App for any illegal purpose

• Violate any laws while using our tours (trespassing, traffic violations, etc.)

• Harass, threaten, or harm others

• Upload malicious code or attempt to compromise the App

• Scrape, data mine, or use automated systems to access the App

• Impersonate others or misrepresent your affiliation

• Reverse engineer, decompile, or attempt to extract source code

• Use the App in any way that could damage, disable, or impair our services

5. Intellectual Property

Our Content: All content provided by Arch Guide—including tour scripts, audio recordings, narration, maps, photographs, design elements, logos, branding, filters, and watermarks—is owned by Arch Guide and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

Your Content: You retain ownership of photos you upload. See Photo Sharing Terms (Section 1) for the license you grant us.

6. User-Generated Content & Photo Sharing

By uploading photos to Arch Guide, you agree to our Photo Sharing Terms (presented separately on first upload). In summary:

• You retain ownership of your photos

• You grant us a perpetual, worldwide, royalty-free license to use them, including on our social media and in marketing

• Photos must focus on architecture, buildings, or neighborhood scenes

• Content moderation applies

• Repeat violations may result in strikes or bans

7. Tour Safety & Liability Waiver

Before starting any tour, you must accept our Tour Safety & Liability Waiver (presented in-app before each tour). This is a separate agreement governing your conduct during tours, including assumption of risk, private property rules, and traffic safety.

8. Conduct & Community Standards

You agree to:

• Be respectful to property owners, residents, neighbors, and other users

• Follow all safety guidelines and local laws during tours

• Report safety hazards or inappropriate content

• Not engage in prohibited activities outlined in the Tour Safety Waiver

Violations may result in warnings, strikes, suspension, permanent ban, or legal action.

9. Termination

Our Rights: We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms, the Photo Sharing Terms, or the Tour Safety & Liability Waiver (each of which is incorporated into and forms part of these Terms)

• Illegal activity

• Documented trespassing or property complaints

• Inappropriate content uploads

• Abuse of the platform or community

Your Rights: You may delete your account at any time through Account Settings. Upon deletion:

• Your public profile and photos are removed from the App within 30 days

• We retain the license to photos you uploaded as outlined in Photo Sharing Terms

• Certain data may be retained for legal, security, or operational purposes (see Privacy Policy)

10. Assumption of Risk & Limitation of Liability

You Assume All Risk: Using Arch Guide tours is at your own risk. You acknowledge that:

• You are responsible for your own safety during tours

• You assume all risk of injury, property damage, or other harm

• You are liable for all parking tickets, traffic violations, towing fees, and other penalties

• We are not responsible for injuries, accidents, theft, or harm occurring during tours

• Building access and conditions may change without notice

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCH GUIDE LA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App

• Conduct or content of third parties on the App

• Unauthorized access to your data

• Injuries or damages sustained during tours

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Arch Guide, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App

• Your violation of these Terms

• Your violation of any law or third-party rights

• Your conduct during tours

• Content you upload

12. Payment, Subscriptions & Apple App Store Terms

• Tour purchases and subscriptions are processed through the Apple App Store

• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the period. You can manage and cancel subscriptions in your Apple ID Account Settings.

• Refunds: All refunds are handled by Apple under its refund policy. We do not process refunds directly.

• Price Changes: We may change subscription pricing; changes take effect at the next renewal after notice.

13. Apple-Specific Terms

You acknowledge that these Terms are between you and Arch Guide only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. To the extent these Terms provide for usage rules less restrictive than the App Store Terms of Service, the App Store Terms govern. You also agree that:

• Apple has no obligation to provide maintenance or support for the App

• Apple is not responsible for any product warranties, whether express or implied

• Apple is not responsible for addressing any claims relating to the App, including product liability, consumer protection, or intellectual property claims

• In the event of any third-party claim that the App or your use of it infringes that party's intellectual property, Arch Guide (not Apple) will be solely responsible for investigation and resolution

• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

• You represent that you are not located in a U.S.-embargoed country and are not on any U.S. government list of prohibited or restricted parties

14. DMCA / Copyright Infringement Notice

If you believe content on the App infringes your copyright, send a DMCA notice to hello@archguide.co including:

1. Your physical or electronic signature

2. Identification of the copyrighted work claimed to be infringed

3. Identification of the allegedly infringing material and its location in the App

4. Your contact information

5. A statement of good faith belief that the use is not authorized

6. A statement, under penalty of perjury, that the information is accurate and that you are authorized to act

We will respond to valid DMCA notices and may remove the content. We may also terminate accounts of repeat infringers.

15. Dispute Resolution & Arbitration

Please read carefully — this section affects your legal rights.

Informal Resolution First: Before filing a claim, you agree to attempt to resolve the dispute by contacting us at hello@archguide.co. We will attempt to resolve the dispute within 60 days.

Binding Arbitration: If we cannot resolve the dispute informally, you and Arch Guide agree to resolve any dispute through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in Los Angeles County, California. The arbitrator's decision will be final and binding.

Class Action Waiver: YOU AND ARCH GUIDE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions: Either party may bring a claim in small-claims court or seek injunctive relief for intellectual property infringement.

30-Day Opt-Out: You may opt out of this arbitration agreement by emailing hello@archguide.co within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and including your name and email.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute not subject to arbitration shall be resolved in courts located in Los Angeles County, California.

17. Modifications to Terms

We may update these Terms at any time. For material changes, we'll notify you via email or in-app notification at least 30 days before changes take effect. Continued use after changes constitutes acceptance. If you don't agree to the new Terms, you must stop using the App.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, Photo Sharing Terms, and Tour Safety Waiver, constitute the entire agreement between you and Arch Guide.
