Tour Waiver

You must acknowledge this waiver before starting each tour (or when a new version is published).

By starting this tour, you acknowledge and agree to the following:

Assumption of Risk

Participating in Arch Guide tours involves inherent risks, including but not limited to:

Pedestrian and traffic hazards
Uneven sidewalks, stairs, and terrain
Weather conditions
Encounters with private property owners, residents, or security personnel
Theft, injury, or property damage

I VOLUNTARILY ASSUME ALL RISKS associated with participating in this tour, whether known or unknown, and agree that Arch Guide is not responsible for any injury, loss, or damage I may suffer.

Private Property & Residential Buildings

This tour may include private residences. I agree to:

View buildings ONLY from public sidewalks
NEVER enter private property, driveways, or yards without explicit permission
NEVER knock on doors, ring doorbells, use intercoms, or otherwise approach, hail, or attempt to contact residents, owners, employees, or guests
Respect residents' privacy — no peering in windows, loitering, or disturbing occupants
Keep noise levels low and be considerate of neighbors
Understand that photographing private homes from public spaces is legal, but trespassing is not
NOT photograph, film, or record identifiable residents, owners, guests, or employees of any featured property without their explicit consent
NOT use drones or other aerial recording devices over or near private property without the property owner's consent
NOT damage, deface, disturb, or interfere with any private property, landscaping, mailboxes, vehicles, gates, fixtures, or belongings
Leave immediately if asked by property owners or residents

I understand:

Private property laws apply — trespassing may result in arrest or prosecution
Arch Guide does NOT grant permission to enter private property
I am solely responsible for any legal consequences of trespassing
Private residences featured on tours may have doorbell cameras, security cameras, or other recording devices, and my presence on public sidewalks near a featured property may itself be recorded by the property owner
I am solely and personally liable for any damage I cause to a homeowner's, resident's, or property owner's real or personal property, and I will indemnify Arch Guide against any related claim

Homeowner & Property-Owner Rights

The private-property protections in this waiver — including the rules above prohibiting trespass, approach, contact, photography of persons, and property damage — are made expressly for the benefit of the homeowners, residents, property owners, tenants, and occupants of the buildings featured on our tours. Those parties are intended third-party beneficiaries of these provisions and may enforce them directly against a user who violates them, in addition to any enforcement by Arch Guide.

If you are a homeowner, resident, or property owner and you would like your building removed from a tour, or you wish to report user misconduct, contact us at hello@archguide.co. We will review takedown requests in good faith and respond within a reasonable time. Featuring publicly visible architecture from public rights-of-way is generally lawful, but we consider takedown requests seriously and may honor them at our discretion.

Commercial Buildings & Lobby Access

This tour may reference commercial buildings. I agree to:

Only enter public lobbies and areas explicitly open to the public
Verify independently that lobbies are accessible — hours and access may change
Never enter restricted areas, offices, upper floors, or employee-only spaces
Leave immediately if asked by security or property management

I understand:

"Public lobby" status mentioned in tours is informational only and subject to change
Arch Guide is not responsible for verifying current access policies
Unauthorized entry into restricted areas is trespassing and may result in prosecution

Navigation & Audio Guidance Accuracy

Arch Guide provides turn-by-turn navigation (via Apple MapKit) and location-triggered audio callouts based on GPS data. I understand:

GPS, mapping, and routing data may be inaccurate, delayed, outdated, or unavailable, and a suggested route may not reflect actual conditions, closures, or property boundaries
Audio callouts are automated and location-triggered; they may occasionally reference the wrong building, fire early or late, or activate near a private property
Neither navigation directions nor audio callouts are a substitute for my own observation and judgment about traffic, terrain, or property lines
I am responsible for independently verifying that any suggested route or destination does not require crossing onto private property, and I will not treat a route, callout, or map pin as permission to enter private property
Arch Guide is not liable for any injury, loss, delay, or legal consequence resulting from reliance on inaccurate or delayed navigation or audio guidance

Traffic Safety & Parking

I agree to:

Obey all traffic laws, crosswalk signals, and pedestrian rules
Stay alert to vehicles, bicycles, and other hazards
Never block driveways, fire hydrants, or traffic
Park legally and follow all posted parking restrictions
Never interact with the App's screen or touch controls while operating a vehicle. If using CarPlay, the App is intended for hands-free audio playback only while driving between stops — I will not attempt to view, tap, or otherwise interact with the phone screen while driving
If wearing headphones or earbuds during a tour, keep volume low enough to remain aware of traffic, vehicles, and my surroundings at all times, and remove or pause audio when crossing streets or in high-traffic areas

I understand:

I am solely responsible for all parking tickets, towing fees, and traffic violations
Arch Guide does not guarantee parking availability
I am liable for any damage to my vehicle during the tour
Reduced situational awareness from headphone use is a known risk I assume by using audio narration while walking or crossing streets

Personal Responsibility & Liability

I agree:

I am solely responsible for my safety, actions, and decisions
I will use common sense and good judgment at all times
I am liable for any harm I cause to others
I am responsible for any legal consequences of my actions, including arrests, fines, or prosecution
Arch Guide provides informational content only and is not liable for my choices
